Business Innovation and Investment (Provisional) Visa (Subclass 188)

The Business Innovation and Investment (Provisional) visa allows you to be employed and reside in Australia. With this visa you have the permission to: 

• Possess and operate a new or current business in Australia, or
• Invest in Australia.

What are the steps in the application process of Business Innovation and Investment (Provisional) Visa (Subclass 188)?

Step 1: Review the requirements. 

You must meet the requirements of the stream you are applying under as well as the Subclass 188 requirements. 

There are four streams in Subclass 188 that you may apply to:

• Business Innovation Stream: 

• • For those who intend to build, acquire and direct a new or current business in Australia. 

• • Nomination by a State or Territory Government or Australian agency is required to have to attain this visa successfully. 

• Investor Stream:

• • For those who intend to make a designated investment of AUD 1.5 million in the Australian Government Bonds, and

• Significant Investor Stream:

• • For those who intend to invest in AUD 5 million into fulfilling significant investments in Australia, and

• • Nomination by a State or Territory Government or Australian agency is required to attain this visa successfully.

• Premium Investor Stream:

• • For those who intend to invest in AUD 15 million into fulfilling premium investments in Australia, and

• • For those who desire to continue business and investment activity in Australia. 

• • Nomination by a State or Territory Government or Australian agency is required to have to attain this visa successfully. 

Step 2: Submit Expression of Interest (EOI) and receive invitation via SkillSelect. 

An Expression of Interest (EOI) must be submitted before making an application visa for Subclass 188. The purpose of the EOI is for the Australian government to decide whether to nominate you based on the business claims that you have submitted. After successfully submitting an EOI, you will receive an invitation to lodge the application via SkillSelect. This invitation is available for 60 days from the date stated in the invitation letter, therefore you will have to apply online for the visa within the 60 days. 

Step 3: Arrange your Documents

You will have to submit several of your documents alongside your application. The Document Checklist provides a list of all the necessary documents.

Step 4: Submit your Visa Application Online

You will have to lodge your application online. During the process, all related documents have to be provided beforehand as well as the visa application fee. You can pay the application fee by credit card.

Step 5: Wait until a decision is made

A decision regarding your visa application can take months.

Step 6: Obtain your visa.

You will receive your visa once your application has been accepted. After receiving your visa, you may start your preparations to start working in Australia. 

What is the processing duration for the visa

The processing time for the visa depends on the completion of the application which includes whether or not you have provided all the necessary documents, your quick response for additional information requested by the officer, the speed of check for additional information by the officer, and the time to receive additional information from other agencies regarding your health, character, and national security assessments. 

What is the cost of this visa?

The cost of the visa for the main applicant depends on the stream that you are applying for. 

• For Business Innovation Stream, the cost for the visa is from AUD 5,000.
• For Investor Stream, the cost for the visa is from AUD 5,000.
• For Significant Investor Stream, the cost for the visa is from AUD 7,000.
• For Premium Investor Stream, the cost for the visa is from AUD 9,000. 

You are required to pay extra costs for additional applicants applying for the visa with you. Cost for additional applicants depends on the stream that you are applying for. 

Further costs are required if you or your additional applicants do not have a minimum of functional English once you lodge your visa application. 

Am I required to have an English basic?

Each applicant who is above the age of 18 years old and is applying for the visa is required to have a minimum of functional English. You must provide proof that these applicants have functional English when you are applying for the visa. 

If you fail to do so, you must pay the second installment of the visa application charge and this must be submitted alongside a statement stating your purpose to pay this additional charge for each applicant who fail to have functional English.

Business Talent (Permanent) Visa (Subclass 132)

The Business Talent (Permanent) Visa (Subclass 132) allows you to build a new business or develop a current business in Australia. To qualify for this visa, you are required to maintain a minimum amount of net business, personal assets, and annual business turnover, or a minimum amount in venture capital funding. Nomination by a State or Territory Government or Australian agency is required to have to attain this visa successfully.

What are the steps in the application process of Business Talent (Permanent) Visa (Subclass 132)?
